Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website, applications, and services (collectively, the "Services") provided by Brooklyn West Labs LLC, DBA MindyRoad ("MindyRoad," "we," "us," or "our").
By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
If you access the Services on behalf of a school, district, or other educational organization, you represent and warrant that you have the authority to bind that organization to these Terms.
1. Eligibility
Educators and account holders must be at least 18 years old.
Student access may occur through anonymous sessions and may not require the creation of individual student accounts. Parents, guardians, or educators are responsible for supervising student use of the Services.
2. Accounts
Certain features of the Services may require account registration.
When creating an account, you agree to:
- Provide accurate information
- Maintain the confidentiality of your login credentials
- Notify us of any unauthorized use of your account
You are responsible for all activities that occur under your account.
3. Acceptable Use
You agree to use the Services only for lawful educational purposes.
You may not:
- Engage in illegal, abusive, or harmful activity
- Attempt to gain unauthorized access to the Services or related systems
- Interfere with the operation or security of the Services
- Collect personal data from children under 13 through the platform
- Use automated tools, bots, scrapers, or crawlers to access or extract information from the Services
- Reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying architecture of the Services
4. Intellectual Property
All content, software, technology, curriculum structures, lesson frameworks, tutoring systems, visual designs, text, graphics, interfaces, and related materials provided through the Services (collectively, the "Platform Content") are owned by MindyRoad or its licensors and are protected by copyright, trademark, and other intellectual property laws.
Except for the limited license granted below, no rights are transferred to users.
MindyRoad grants users a limited, non-exclusive, non-transferable license to access and use the Services for personal educational purposes.
Lesson content created by educators using the platform may remain the property of the educator or their institution.
5. Platform Restrictions
You agree that you will not, and will not permit any third party to:
- Copy, reproduce, distribute, sell, lease, or sublicense any portion of the Services or Platform Content
- Reverse engineer, decompile, disassemble, or attempt to derive the source code, algorithms, prompts, or underlying systems used by the Services
- Attempt to extract or replicate curriculum structures, tutoring methodologies, lesson generation systems, or other proprietary educational frameworks
- Use automated systems such as bots, crawlers, or scraping tools to collect or reproduce platform content
- Access or use the Services to build a competing product or service
Unauthorized use may result in termination of access and potential legal action.
6. AI-Generated Educational Content
The Services may include AI-assisted tutoring and automated educational responses.
AI-generated content:
- Is provided for educational support purposes
- May not always be accurate or complete
- Should be reviewed by students, parents, or educators
MindyRoad does not guarantee the accuracy or reliability of AI-generated content.
7. Restrictions on AI Training
Users may not use any content, lessons, responses, tutoring conversations, or outputs generated by the Services to train, fine-tune, or otherwise develop machine learning models or artificial intelligence systems without prior written permission from MindyRoad.
8. Student Privacy and Compliance
MindyRoad is designed to minimize the collection of personal information from students.
Student sessions may be anonymous and may not require personal account creation.
Where applicable, MindyRoad aims to comply with relevant student privacy laws including:
- Children's Online Privacy Protection Act (COPPA)
- Family Educational Rights and Privacy Act (FERPA)
Parents, guardians, and educators remain responsible for determining how the Services fit within their educational programs.
9. Use of YouTube Content
Some features of the Services access or display content from YouTube via the YouTube API Services.
By using these features, you agree to be bound by the YouTube Terms of Service.
10. Termination
We reserve the right to suspend or terminate your access to the Services if:
- You violate these Terms
- Your use of the Services poses risk or legal exposure to MindyRoad
- The Services are discontinued
Users may stop using the Services at any time.
11. Disclaimer of Warranties
The Services are provided "as is" and "as available."
To the fullest extent permitted by law, MindyRoad disclaims all warranties, including warranties of:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
We do not guarantee uninterrupted access or error-free operation.
12. Limitation of Liability
To the maximum extent permitted by law, MindyRoad will not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Services.
Our total liability for any claim related to the Services will not exceed the amount paid for the Services during the preceding 12 months.
13. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Any disputes arising from these Terms shall be brought in courts located in Santa Barbara County, California.
14. Changes to These Terms
We may update these Terms periodically.
Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
